GUWAHATI: Justice Kateswar Singh of the Gauhati High Court has set aside and quashed the impugned final gradation list of November 10, 2017 and directed the authorities of the Elementary Education Department to prepare a fresh gradation list as per the mandates given on May 9, 2000.

With this the High Court disposed of the WP(c) No.7460 of 2017 jointly filed by Silchar SI Bishwajit Dey and Nagaon SI Pranab Kumar Bora challenging the final gradation list of November 10, 2017 meant for the incumbent for the post of SI of Schools published by the Director of Elementary Education, Assam.

On Thursday, the single-judge bench of Justice Kateswar Singh, after hearing the Advocate for the petitioners Bishwajyoti Purkayastha, has disposed of WP (C) No. 7460 of 2017 jointly filed by Bishwajit Dey, SI of Schools of Silchar and Pranab Kumar Bora, SI of Schools of Nagaon.

The challenge was made on the ground that the impugned gradation list dated November 10, 2017 has been published by DEE, Assam on the basis of date of joining in service of the incumbent and not on the basis of merit of the incumbent at the entry level.

The judgment of May 9, 2000 of the High Court passed in CR No.4682 of 1998 mandates that the gradation list for the post of SI of Schools has to be prepared on the basis of merit of the individual at the entry level in service.
