Gauhati High Court stays eviction drive in Uzanbazar area of Guwahati

The Gauhati High Court has directed the Northeast Frontier Railway (NF Railway) not to go ahead with its eviction drive in the Uzanbazar area of the city.

GUWAHATI: The Gauhati High Court has directed the Northeast Frontier Railway (NF Railway) not to go ahead with its eviction drive in the Uzanbazar area of the city.

The NF Railway had issued a notice dated 27.01.2023 to people who have allegedly encroached upon railway land in Uzanbazar. The notice stated that the railway land encroached upon by the people should be vacated on or before February 7. Some of the aggrieved people approached the Gauhati High Court for relief and filed a writ petition (WP(C)/570/2023). The counsel for the petitioners argued that the land is in the possession of the petitioners, who are six in number, from a considerably long period of time.

The court stated that till the issue returnable date (20.2.2023), the impugned communication dated 27.01.2023 issued by the NF Railways pertaining to the eviction of the petitioners shall not be given effect to. The court directed the Deputy Surveyor General of India (Deputy SGI)to ascertain whether notices have been issued in the names of similarly situated persons or not.

The court order stated, "It is however made clear that without issuing specific notice, eviction of any kind may not be resorted to."
