GMC order not applicable to motor-fitted Dipbahan rickshaws: Gauhati HC

The Gauhati High Court has stated that the (GMC) order to stop the operation of motorized rickshaws would not be made applicable to motor-fitted Dipbahan rickshaws.

GUWAHATI: The Gauhati High Court has stated that the Guwahati Municipal Corporation’s (GMC) order to stop the operation of motorized rickshaws would not be made applicable to motor-fitted Dipbahan rickshaws.

The GMC had issued a notification dated 28.12.2022 whereby the operation of motorized rickshaws had been stopped. Aggrieved by this notificiation, the Xadou Guwahati Motor Chalita Rickshaw Chalak Union had filed a writ petition (WP(C)/1648/2023) in Gauhati High Court.

The GMC as well as the Transport Department informed the court that such restrictions were only for retrofitted with electric motor which are unsafe for commuters. On the other hand, the petitioners informed that a similar petition was moved before the court in which the interim protection was restricted only to Dipbahan rickshaws fitted with motor.

The court stated that it was not inclined to pass a blanket order of stay of the impugned order dated 28.12.2022. However, the court made it clear that the order would not be made applicable to motor-fitted Dipbahan rickshaws.
