GUWAHATI: The Assam Police is on its toes to stop the menace of drugs. Every day, police teams across the State are busting drug rackets, arresting peddlers and recovering narcotics and cash. However, not every time the police is successful in bringing the drug peddlers to justice. On Monday, the Gauhati High Court granted bail to a woman who was arrested under the NDPS (Narcotic Drugs and Psychotropic Substances) Act after the Guwahati Police failed to file chargesheet within the stipulated time.
"I have found force in the contention raised on behalf of the accused petitioner. As no charge sheet has been submitted to date, the accused petitioner is entitled to default bail under Section 167(2), CrPC," stated an order by Justice Manish Choudhary.
The accused, Bimala Kalita was arrested by the Basistha Police following an FIR (First Information Report) lodged on 02.04.2021. The police had recovered two kg suspected ganja from the house of Kalita. Accordingly, a case (632/2021) was registered for offences under Sections 20(b)/29 of the NDPS Act. After arrest, the accused was remanded into custody on 03.04.2021 and since then she was in custody.
