Sam Stafford case: Kamrup (M) Chief Judicial Magistrate (CJM) Court recommends compensation

GUWAHATI: The Kamrup (M) Chief Judicial Magistrate (CJM) Court recommended compensation for the next of kin (father) of Sam Stafford who was shot dead in Guwahati on December 12, 2019.

Citing the post-mortem report, the Court said that Sam Stafford (17), a minor, died due to shock and haemorrhage as a result of injuries sustained over the body. The court said that all the injuries were ante-mortem and were caused by rifled firearms except injury numbers 1, 2, 3, 4 and 7.

"Considering all the aspects of the case, nature and gravity of the offence and considering the age of the expired victim, the financial condition of the family of the victim, I am of the opinion that although the offender, in this case, is not identified till date, this is a case where victim compensation should be given and therefore, I recommend this case for victim compensation to District Legal Services Authority under Section 357 A of CrPC and Assam Victim Compensation Scheme. Hence, let a copy of this order along with a copy of the FIR, FR (Final Report) and post-mortem report of the victim be sent to the District Legal Services Authority for victim compensation to the father of the expired victim who shall appear before the District Legal Services Authority, Kamrup (Metro), Guwahati, as per the Victim Compensation Scheme under Section 357 A of CrPC," CJM AK Baruah said in his order.

"After hearing the petitioner and materials on record, it appears that another case in respect of the same offence being Hatigaon PS case (948/2019) was registered," the CJM said, ordering that a report be called from the Investigator Officer of the Hatigaon PS in this case.

The CJM fixed November 3, 2022, for the next hearing of this case.
