Bengaluru: The Karnataka High Court has refused to quash a case against a man who forced his wife for anal sex/unnatural sex.
Simultaneously, the court also granted the contention of the woman for further investigation against her husband for allegedly circulating her obscene pictures on social media platforms.
The woman has accused her husband of being torturous for having anal/unnatural sex from the very beginning and also claimed that the husband allegedly forwarded obscene pictures of her to the Facebook account of her father and WhatsApp numbers of her two friends.
Following all these tortures, the woman eventually filed a police complaint in her native Chattisgarh which was later transferred to Bengaluru to be investigated by the jurisdictional police.
According to a report by PTI, the woman has also made her mother-in-law an accused. However, in 2019, the High Court had quashed the case against the husband's mother.
Since both the husband and wife approached the High Court on various grounds; the husband sought the quashing of the case against him.
However, the wife's petition also contended that the charge sheet filed by the police was knowingly diluted in her case, and in addition, the crime under the IT Act was also not properly investigated.
Justice M Nagaprasanna while hearing the petition observed that there is no document placed on record by the husband to demonstrate his innocence.
Eventually, the court allowed the petition of the wife and ordered the Commissioner of Police to further investigate the crime by another investigating officer.
