PORBANDAR: A vegetable vendor in Porbandar filed a petition appealing the court to annul his marriage, claiming that his partner had married him without ending the marriage with her first husband. However, the court denied accepting the petition filed by him.
As per the petition, the woman’s former husband had some sort of criminal history in the state of Assam. The petitioner has been identified as Vimal Kariya, and his lawyer Bharat Lakhani initiated the proceedings. In the petition, Lakhani mentioned that the marriage was unlawful as per section 12 of the Hindu Marriage Act.
Unfortunately, the duo failed to submit necessary evidence in connection with Kariya’s wife’s divorce petition with a court in Assam. Lakhani further stated that, there are two ways the case could be resolved.
One is to oppose the order before the high court or file a divorce on grounds of cruelty. Kariya registered the petition in June 2022, but his wife who was in Assam did not respond to any of the court’s notice. Kariya went on stating the facts about their marriage, where it was revealed that the couple met in an online matrimonial site. His wife said that her name was Rita Kaibarta and she hails from Assam’s Kamrup district. The couple got married after dating for one month, in October 2021.
The woman misleaded Kariya about her divorce. Kariya informed police that they were together for six months, and during the phase he discovered that Rita was an uncultured woman. He spotted her getting engaged in verbal fight over video calls. In March 2022, Rita came back to Assam stating that her presence is needed for some land related family matter.
After a few days, Kariya came to know that Rita was nabbed by Assam police. In order to make her release, Kariya sent an amount of Rs One Lakh in instalments to the advocate. During the process, he discovered that Rita’s actual title is Chauhan. He later researched about her and realised that her former husband and she was were wanted in several cases.
Her husband was already in jail and in order to escape the situation and arrest, she married Kariya.
