NEW DELHI: The Punjab and Haryana High Court has made it clear that it will decide whether or not to uphold applications for habeas corpus brought by some families of the associates of radical Sikh preacher Amritpal Singh who are being held in Assam.
The court has also directed the removal of the official's name from the writ petition after expressing surprise over impleading the Dibrugarh jail superintendent in Assam as a respondent in the habeas corpus case submitted before the HC.
The HC stated that "it is expected that he (the petitioner's lawyer) will come prepared to justify the maintainability of the writ petition in the manner in which it has been presented before the court," indicating that it was apparently unsatisfied with the habeas petition filed regarding those held in the Assam jail.
The High Court noted that the petitioner's attorney acknowledged that there were no personal claims against Srabana Sonowal, ACS, the superintendent of the Central Prison in Dibrugarh, and that she had only been impleaded as an official. "Once an official is obliged to be impeached, they must do so using their designation rather than their name. Srabana Sonowal, ACS, Superintendent of Jail, Central Jail, Dibrugarh... is consequently removed from the list of parties”, the HC followed its directives.
The high court's Judge Anil Kshetarpal issued these instructions while also pointing out that the petitioner had not specified the justifications for the purported detention of the detenues. The case has now been postponed until April 11 for another court hearing.
Amritpal Singh travelled to Georgia for cosmetic surgery to look like Jarnail Singh Bhindranwale before arriving in India and assuming control of Waris Punjab De. The information came from Amritpal Singh's close associates, who were detained in the Waris Punjab De operation and are currently being held in the Dibrugarh Central Prison.
