HRLN Writes to Itanagar Capital Complex DC, Demands Details on Illegal Detention of Minor

ITANAGAR: The Human Rights Law Network (HRLN), in a letter to the Itanagar Capital Complex (ICC) Deputy Commissioner and SIT of the state police SP, has demanded a detailed explanation and clarification on the illegal detention of a minor girl during the 72-hour bandh call by a few organization in the state capital, Itanagar.

The human rights organization appealed to the concerned authority to conduct a thorough investigation into the matter and take appropriate action against those responsible for the oversight.

It also expressed deep concern and sought clarification regarding the distressing incident. The organization claimed that the district administration and the police unlawfully detained a minor girl under the Arunachal Pradesh Unlawful Activities (Prevention) Act 2014 (APUAPA) in connection with the 72-hour bandh call from May 10 to May 12, 2023.

Terming the detention as a "glaring blunder, the HRLN stated that it is alarming to note that such a grave error was made, leading to the unjustifiable detention of a minor for a period of 16 days. Also, it questioned the due process followed by the authorities in following the established protocols in the matter.

The minor's illegal detention for such a prolonged period raises questions about the competency and knowledge of the personnel responsible for the arrest and subsequent handling of the case. According to the Juvenile Justice (JJ) Act, it is imperative that a minor be immediately produced before the Juvenile Justice Board (JJB) upon discovery of their age.

Further, HRLN also claimed that the officials didn’t follow the procedures, as the minor was not promptly presented before the JJB but instead sent to the Juvenile Home in Pasighat.
