Section 144 CrPC promulgated across Lakhimpur district

LAKHIMPUR: By issuing an order vide No. LMG. 03/2019/120, Deputy Commissioner-cum-District Magistrate of Lakhimpur, Sumit Sattawan has promulgated 144 CrPC across the district in view of celebrating the upcoming Independence Day in a peaceful and harmonious environment. This measure has been initiated in order to check the apprehension, likelihood of disturbances, extremist activities causing threats to the public peace and harmony in different parts of the district on the eve or during the celebration of the national festival and also to thwart the nefarious attempts of rumour mongers and to restrict the movements of insurgents.

The order has prohibited the assembly of five or more persons in any public place including NH-15 without specific permission from the District Magistrate and Additional District Magistrate, carrying of lethal weapons and arms in public places including daggers, sticks, spears, swords, bows and arrows etc. that can be used as weapons, holding of rallies, meeting, gatherings and public events in public places in the light of government instructions without permission, public rally, procession, demonstrations, strikes including hunger strikes, dharnas, shouting, slogans etc. in public places, causing obstruction to public roads and highways, footpath and normal movement of traffic, inflammatory speeches, communal or anti- state anti- national speeches, slogans, banners, postering, wall writing, shouting of any provocative anti-state slogans, any act in any public place by any person which may spread ill feeling and enmity against any community and or which may disturb the communal peace and harmony and gherao of any person, office premises, godown etc.

The order prohibiting assembly of person at public places will however not be applicable in the case of assembly of persons marketing, shopping in market places, educational institutions for academic purpose and railway station, bus stands for travels only and gathering in normal course of works or business or performing marriage ceremony. The order will also not be applicable in respect of police and army personnel on duty magistrates. judicial officials and person engaged in government business. This order has come into force with immediate effect across the district and will remain in force until further order is served.
