Senior Advocate Kardak Ete Should Be Appointed As Gauhati HC Judge: SC

GUWAHATI: The Gauhati High Court's Collegium, which consists of Justices Sanjay Kishan Kaul and K. M. Joseph as well as the then-chief justice and the two senior-most judges, unanimously made the recommendation on December 1, 2022, according to the Collegium.

It was observed that the recommendation has the support of the governors and chief ministers of Assam, Arunachal Pradesh, Mizoram, and Nagaland.

According to the Supreme Court Collegium, the justices of the Supreme Court acquainted with the operations of the Gauhati High Court were contacted in order to determine the fitness and appropriateness of Kardak Ete for promotion to the High Court, in accordance with the Memorandum of Procedure.

"We have examined and assessed the information provided on record in order to determine Kardak Ete's merit and suitability for elevation to the High Court. We have also read over the notes that the Department of Justice made in the file”, the court stated.

According to the Intelligence Bureau's report, he has a positive personal and professional reputation, and nothing dishonest has been discovered regarding his integrity.

Beyond his own skill and reputation at the bar, Kardak Ete's selection will increase diversity and inclusiveness in the High Court.

Thus, the Collegium decides to suggest that Kardak Ete, an advocate, be appointed as a judge of the Gauhati High Court, according to the resolution.

Recently, Justice Sandeep Mehta has been appointed as the Chief Justice of Guwahati High Court. Justice Mehta took his oath on 15th of February, Wednesday. Prof. Jagdish Mukhi was also present at the ceremony. 

The official was appointed in the position of Chief Justice of Guwahati HC on 12th of February, Sunday. Mehta has replaced Justice RM Chhaya, who completed his tenure as the Chief Justice in Guwahati and got retired from the post, recently. Ever since then, the position was vacant in the court. 

It is worth mentioning here that, Justice Mehta served as a senior judge in Rajasthan High Court, following his appointment in 2011, 30th May. As per the reports, the official will retire in the year 2025, on 10th of January. His appointment came after the reference made by the Supreme Court Collegium.
