GUWAHATI: The Court of the Special Judge here has framed charges against former DIG (border) Rounak Ali Hazarika, who has been accused of possessing assets disproportionate to his known sources of income.
Formal charges were also filed against his wife Nusrat Rounak Hazarika and friend Farid Ali, with both of them charged with committing offences punishable under Section 120-B IPC, read with Section 13(2) of the Prevention of Corruption Act.
The charges against Rounak Ali Hazarika have also been filed under Section 120-B IPC, read with Section 13(2) of the Prevention of Corruption Act, for violation of provisions under Section 13(1) of the P.C. Act.
It is necessary to mention here that Rounak Ali Hazarika and his wife, Nusrat Rounak Hazarika, were investigated by the CM's Special Vigilance Cell and found to possess 164.80 percent of assets disproportionate to their known sources of income. After computation of his assets, income, and expenditure, it was found that he possessed disproportionate assets to the tune of Rs 2,87,89,303 against his known sources of income. His wife had been working at a job for the past 3 to 4 years, it was revealed.
During the investigation, it was revealed that Rounak's friend, Farid Ali, conspired with him to accumulate illegal property. So, he was also arrested. Later, however, Farid Ali was released on bail.
Rounak Ali Hazarika was also released on bail secured from the Supreme Court. His wife was not arrested, but she appeared in court after receiving summons, and she was also released on bail.
The couple then filed two petitions, separately, under Section 239 of CrPC, with a prayer to discharge them.
An inquiry was conducted into the matter, and it was found that, between 1992 and 2021, accused Rounak Ali Hazarika acquired a number of movable and immovable assets in his and his wife's names, which is disproportionate to his known sources of income.
After considering the materials on the case record and case diary, it appeared to the court that the accused, Rounak Ali Hazarika, being a public servant, allegedly acquired huge property in his and his wife's names, and the accused, Farid Ali, being his friend, committed a criminal conspiracy to acquire huge property, both movable and immovable.
The Court of the Special Judge thereby framed the charges and dismissed their petition.
