DHULA PS MURDER CASE: CID files charge sheet against suspended SP, ASP and OC

GUWAHATI: The CID has filed the charge sheet before the Special Court, Guwahati, against the then Dhula PS OC Uptal Borah, then Darrang SP Raj Mohan Ray, then Darrang Additional SP Rupam Phukan, and Niju Nath in connection with the murder case (20/2022) of a minor girl at Dhula in 2022.

During its investigation, the CID found that the then Dhula OC SI Utpal Borah had accepted illegal gratification of Rs 5 lakh in three installments during June and July 2022 for himself and the then Darrang SP and Additional SP. The investigators gathered information like bank details, like the person who had withdrawn the money and from where. The CID said that the call details, call link analysis, and geo tower analysis of all the mobile numbers, along with the mapping of the travel history, proved that the bribe amount was paid in three installments as a reward for extending undue favour to the accused, Krishna Kamal Baruah, the main accused in the Dhula PS murder case. The accused wife, Niju Nath, mobilized the bribe amount and paid that to then-OC Utpal Borah through her relatives, the CID said.

The CID further said that the FSL’s (Forensic Science Laboratory) voice spectrography report made it clear that the tele-conversation retrieved from the mobile phone of the accused matched with the voice samples of Utpal Borah and Raj Mohan Ray. The conversation revealed that then SP Raj Mohan Ray was instructing the then OC Utpal Borah to extend favour to the accused, the CID added.

“The investigation revealed that all three police officers willfully violated the provisions of the Assam Police Act, 2007, extended undue favours to the accused, tried to screen and protect the accused, Krishna Kamal Baruah, who is involved in the murder and attempted rape of the minor girl child, and obtained bribe money as a reward,” the CID said.

The CID obtained the prosecution sanction against the three police officers.

The CID charged the three police officers and Niju Nath under Section 120(B), 201 IPC, Section 7(b), 8(1)(ii) of the PC Act, 1988 (as amended in the year 2018), and Section 98(a) of the Assam Police Act, 2007 for offences of criminal conspiracy, destruction of evidence, public servant accepting bribes, and bribing a public servant against then OC Utpal Borah, then SP Raj Mohan Ray, then Additional SP Rupam Phukan, and Niju Nath, along with 36 documents, 24 material objects, and 61 witnesses.
