GUWAHATI/Nagaon: The Gauhati High Court on Monday quashed criminal proceedings against Union Minister of State for Railways and Nagaon MP Rajen Gohain in an alleged sex scandal. The criminal proceedings registered as P.R.C No.1781/2018 was pending in the Court of Chief Judicial Magistrate, Nagaon. The High Court order came after a single-judge bench of Justice Suman Shyam heard a criminal petition filed by Rajen Gohain. Justice Shyam set aside the order passed by the Nagaon Chief Judicial Magistrate on November 17 in 2018 taking cognizance of the criminal proceedings.
On August 1 in 2018, Nagaon police had registered an FIR 2592/18 under sections 417 (punishment for cheating), 376( punishment for rape) and 506 (punishment for criminal intimidation) of the Indian Penal Code against Gohain. The FIR was lodged by a woman accusing Gohain of having sexual relationship with her and her sister-in-law by promising them of giving jobs.
After completing its investigation, the Nagaon police had submitted the Final Report (FR) to which the victim woman did not raise any objection. The Court of Chief Judicial Magistrate, Nagaon had, however, rejected the FR on November 16, 2018 and took cognizance of the offences under Section 417/376/506 of IPC against Gohain on November 17 last year.
Senior advocates Nilay Dutta, Tanmay Jyoti Mahanta, Pankaj Protim Dutta and Arunav Phukan represented Gohain in the court.
