Gauhati High Court reprimands Assam Agriculture Director Anant Lay Gyani

GUWAHATI: The bench of Justice Sanjay Kumar Medhi reprimanded Assam Director of Agriculture Anant Lay Gyani on Wednesday for the latter’s inconsistency between what he submitted before the court in person and his affidavit submitted seeking an apology to the Court for his misinterpretation in issuing a work order. The bench even asked Gyani why contempt proceedings should be initiated against him for not being truthful to the court.

The bench asked Gyani to remain personally present in the court on April 21 and 26, 2023, when the writ petition has been listed for the next hearings.

The bench said that pursuant to the order issued on April 12, 2023, Gyani was personally present. The Agriculture Department’s counsel submitted that an affidavit had also been filed by serving a copy on the other side, which, however, was not with the records. “However, the learned standing counsel has passed on a copy of the same. The affidavit contains an apology by Gyani, who is personally present. The above-named incumbent has also been heard in person, and as a part of his explanation, he submits that work orders were inadvertently issued by misinterpreting the order of this Court and also in terms of an email from the World Bank. Juxtaposed with the records, the email appears to have been received on April 6, 2023, at 5.04 p.m., while the work orders were also issued on April 6, 2023. The said action does not appear to be consistent with the version of the aforesaid incumbent,” the order said.

The Court directed Anant Lal Gyani to file an affidavit explaining the same within a week.
