Implementation of Sec. 12(1) C of RTE Act: Assam Government prepares Cabinet memorandum

GUWAHATI: The Assam Government informed the Gauhati High Court that its Department of School Education has prepared a Cabinet Memorandum for placing it before the Cabinet for smooth implementation of Section 12(1) c of the RTE Act. Prior to that, the department sent the Cabinet Memorandum for inter-departmental views and consultations.

Advocate R. Mazumdar, the standing counsel of the School Education Department, submitted before the bench of the Gauhati High Court, comprising Chief Justice (acting) Lanusungkum Jamir and Justice N. Unni Krishnan Nair, on Friday that "for smooth implementation of Section 12(1)c of the RTE Act, the Department of School Education has prepared a Cabinet Memorandum for placing before the Cabinet, and prior to that, inter-departmental views and consultations are being sought".

The bench was hearing the PIL (30/2023) filed 'We for Guwahati Foundation' for denying admission to children belonging to economically weaker sections and disadvantaged groups under the RTE Act.

Advocate Mazumdar prayed for two weeks to place the factual report before the High Court.

In an earlier hearing of this PIL, the departmental advocate submitted before the court that the Department of School Education had developed a portal, and the file was to be placed before the Cabinet for the final decision.

The bench listed the PIL for its next hearing on December 4, 2023.

Section 12(1) c of the RTE Act mandates unaided private schools to reserve 25 percent of their entry-level seats for children belonging to the economically weaker section and disadvantaged groups.
