GUWAHATI: Even divorced daughters, who were dependent on their deceased parent, are eligible for the family pension of the deceased parent. It is subject to the condition that the authorities are satisfied with the dependency factor of the divorced daughters on the deceased parent.

Justice Sanjay Kumar Medhi of the Gauhati High Court ruled this recently in a case filed by Hasiba Begum {WP(C) 8395/2019} claiming the family pension benefits of her deceased mother.

The petitioner's mother, Late Mehmuda Begum, did work in the Public Health Engineering Department, Assam as a khalasi, and died before retirement. Hasiba Begum is the only next of kin of her deceased mother. She was solely dependent on the income of her mother. She got married on December 30, 2013, but got divorced on September 24, 2014. After the divorce, she was living with her mother.

The court says that 'there will not be a major difference between an unmarried or a divorced daughter as the pivotal ground is the ground of dependency'.
