Promotion rules for Class I & II posts relaxed

GUWAHATI: The State Government has relaxed some provisions of the promotion rules for Class I and II posts to ensure regular promotion. It came to the attention of the government that the promotions of Class I and II officers get delayed due to certain provisions in the Rules.

In this regard, the Department of Personnel issued an office memorandum recently on the policy of issuing orders of regular promotions without resorting to Regulation 4(d) of the Assam Public Service Commission (Limitations and Functions) Regulations 1951.

According to the office memorandum, the State Government has observed that, at times, there is a delay in the issue of orders of regular promotion in the case of various cadres and posts due to:

Provisions in the Service Rules that provide for obtaining approval of the Assam Public Service Commission on the recommendation for promotions made by the Departmental Promotional Committee.

Orders of promotion under Regulation 4(d) of the APSC (Limitations and Functions) Regulation, 1951, are issued even when there are no applicable service rules, and thereafter, the recommendations of the DPC (departmental promotion committee) on promotion are sent to the APSC for approval.

After careful consideration of the matter and in the interest of public service, the following guidelines are circulated in this regard for the compliance of all concerned:

All Administrative Departments will move for the deletion of the provision of Service Rules that provides for seeking approval of the APSC on the recommendations of the DPC for promotions in respect of promotions to Class I and Class II posts where direct recruitment is done through the APSC.

In cases where there are no Service Rules, and the DPC has recommended promotion, the department will issue regular promotion orders instead of promotion orders under Regulation 4(d) of the APSC (Limitations and Functions) Regulation, 1951.

The senior-most secretaries of all departments are to ensure that orders of promotion are issued after due diligence and full compliance with government rules and norms.

All the proposals for amendment of the Service Rules doing away with the provision of seeking approval of APSC for promotion from one gazetted post to the next higher grade are to be placed before the Cabinet by October 31, 2023.
