Delhi High Court gives Nirbhaya rape convicts a week’s time to seek any legal course

NEW DELHI: The Delhi High Court on Wednesday gave Nirbhaya rape convicts a week’s time to seek any sort of legal help or remedy after which proceedings for their execution will start.

The Court also said that all four convicts will be hanged together and not separately.

Lawyers for Nirbhaya’s parents on Tuesday made an urgent mentioning before Justice Suresh Kumar Kait of the Delhi High Court seeking early disposal of the Centre’s plea for vacating the stay on the death warrants against the four convicts in the gang-rape and murder case.

"Delhi Prison Rules do not say that if mercy petition of one convict is pending, the execution of the other convicts can take place," said Justice Suresh Kait, who was hearing the case.

Nirbhaya's mother told reporters, “I'm glad that the High Court has set a time limit for the process. The convicts have been delaying it, now it has to done within a week," Nirbhaya's mother told reporters, according to media reports.

Lawyers for Nirbhaya’s parents on Tuesday made an urgent mentioning before Justice Suresh Kumar Kait of the Delhi High Court seeking early disposal of the Centre’s plea for vacating the stay on the death warrants against the four convicts in the gang-rape and murder case.

“Justice Kait responded that he held a hearing on Saturday and Sunday which shows that the court understands the urgency of the matter and also assured that he will pass the order at the earliest,” said Jitendra Jha, counsel for the parents.

The Delhi High Court had on Sunday reserved its order on a plea filed by the Central government challenging the trial court order, which had stayed for an indefinite period, the execution warrants issued against the four convicts in the Nirbhaya gang rape and murder case – Akshay, Pawan, Mukesh, and Vinay.
