Kerala becomes first state to file suit challenging CAA in Supreme Court

Kerala government has become first among other states to file petition, challenging CAA in Supreme Court. It has done so under Article 131 that allows the states to challenge government of India in the Supreme Court. The petition claims that CAA is unconstitutional and goes against the vary fabric of Indian secularism. In addition to this CAA violates right to life and right to equality.

The petition talks about the plight of Hindus, primarily of Tamil descend, in Sri Lanka and Hindu Madhesis in Terai of Nepal.

The petion argues, "The Impugned Amendment Act and Rules and Orders are discriminatory in so far it covers only religious persecution, among persecutions on very many grounds, of an irrationally chosen class of minorities in an unreasonably chosen class of neighbouring countries."

The Kerala state assembly had already passed a resolution against CAA in December last year. Some 60 petitions have already been filed against CAA in the apex court. CAA aims to protect religiously persecuted Hindus, Sikhs, Buddhists, Jains, Parsis and Christians from Afghanistan, Bangladesh and Pakistan by giving them Indian Citizenship. The cut-off date for those to be given citizenship in India has been fixed at, on or before 31st December 2014.
