Advocate Dharmananda Deb Hails Triple Talaq Bill

Silchar: In a massive step towards women empowerment, Triple Talaq Bill has finally been passed in both houses of the Parliament. Muslim women won the fight against triple talaq. Eminent advocate Dharmananda Deb said, “I congratulate the victim women who had been fighting for long against this practice. There should be no politicization. I also congratulate Prime Minister Narendra Modi and his government under whose leadership history has been created.”

He further said, “The Muslim Women (Protection of Rights on Marriage) Bill, 2019 i.e. Triple Talaq Bill, 2019 contains only 3 Chapter and 8 Sections. According to Section 3 of the Bill, any pronouncement of talaq is void and illegal. Section 5 of the Bill also provides any Muslim husband who pronounces talaq shall be punished with imprisonment for a term which may extend to three years and shall also liable to fine.”

Dharmananda Deb said, “Very important section of the Bill is Section 7(c). According to this section, no person accused of an offense punishable under this bill shall be released on bail unless the Magistrate, on an application filed by the accused and after hearing the married Muslim Women upon whom talaq is pronounced, is satisfied that there are reasonable grounds for granting bail to the person. As per the Bill, Magistrate means a judicial magistrate of the first class. It is a Bill to protect the rights of Muslim married women and to prohibit divorce by pronouncing talaq by their husbands.”

“This bill, which makes instant triple talaq or talaq-e-biddat a punishable offense, follows the Supreme Court judgment on August 22, 2017, in the case of Shayara Bano vs. Union of India. In a majority 3:2 judgment the Apex Court set aside instant talaq as a “manifestly arbitrary” practice. It also said, “Given the fact that triple talaq is instant and irrevocable, it is obvious that any attempt at reconciliation between the husband and wife by two arbiters from their families, which is essential to save the marital tie, cannot ever take place. The objective of the legislation was to ensure the larger Constitutional goals of gender justice and gender equality of married Muslim women and help subserve their fundamental rights of nondiscrimination and empowerment,” he added.
