GUWAHATI: The District Consumer Disputes Redressal Forum, Kamrup has ordered Neha Builders Real Estate Developers of BeltolaBasistha Road, Guwahati to pay compensation of Rs 5,10,000 to the residents of Bali Enclave of VIP Road, Guwahati for deficiency in service. The Forum also ordered to pay the compensation within 45 days to the complainant. On behalf of 12 flat owners of Bali Enclave, Prabin Kumar Das filed a complaint with Consumers' Legal Protection Forum (CLPF), Assam, a consumer rights organization alleging that Neha Builders Real Estate Developers has not provide required amenities in spite of full and final payment.
The CLPA said that the complainant took possession of the flats in the year of 2013. "The facilities as per commitment made in the advertisement have not been provided by the builders. Even complete electricity connection like earthing, individual energy meter, security measures, parking space for vehicles, sanitary and fire fighting arrangement, proper lift installation, handover of possession certificate was also not provided by the builder. The builder assured in writings to fulfill some of the incomplete works but nothing has been done," the CLPF stated in a statement.
Inspite of all correspondence made by the residence of Bali Enclave the builder failed to redress the grievances for which the residence has to suffered irresponsible loss injury and hardship, the CLPF underlined.
On the basis of the joint complain of the 12 flat owners of Bali Enclave, on 2017, Consumers' Legal Protection Forum filed a case with District Consumer Disputes Redressal Forum, Kamrup of case no 26/2017 under Section 14(d) of the Consumer Protection Act 1986. On behalf of forum Advocate AjoyHazarika and Advocate S.M Sarma appeared before the Redressal Forum.
