Gauhati High Court on accommodation of Judicial Officers

GUWAHATI: The Registrar General of Gauhati High Court and All Assam Lawyers' Association (AALA) had moved the Gauhati High Court regarding certain inconveniences caused to a Senior Judicial Officer in Assam Judicial Service, Grade-I in the district of Dhubri regarding temporary accommodation which was given to him in the Dhubri Circuit House.

During the hearing of this case (WP(C)/5873/2006) along with linked case, Justice N. Kotiswar Singh, Justice Manash Ranjan Pathak and Justice Suman Shyam stated, "This issue highlights the problems faced by Judicial Officers at the time of transfer/posting in the different districts of Assam including other States under the jurisdiction of this Court. In this regard, we would like to have an idea of the present position in the other districts in the state of Assam as well, so that a uniform decision can be taken for which the Registry of this Court shall collect all necessary information from all the District Judges about the availability/non-availability of accommodation of the Judicial Officers in their respective districts."

The court directed that similar exercise will also be undertaken by the Deputy Commissioners of all districts concerned in coordination with the District Judges of the districts concerned to address the issue related to the lack of accommodation of the Judicial Officers in the State.

The court order stated, "Accordingly, the State Government as well as the Registry of this High Court will file detail affidavits respectively after obtaining necessary information from the different districts. This direction will also be applicable to the States of Nagaland, Mizoram and Arunachal Pradesh. The States of Nagaland, Arunachal Pradesh and Mizoram accordingly shall also file their updated affidavits respectively and the Registry of this Court shall also file affidavit in respect of the other States also."

The court directed that the affidavits should be filed by December 17, 2021, so that the matter could be taken up on December 20, 2021, for further consideration.

The court further directed that the Judicial Officer, who had been temporarily accommodated in the Dhubri Circuit House, should be allowed to remain in Circuit House and not be shifted to another location until further order of the court.
