Gauhati High Court raps Advocate Utpal Goswami for abusive behaviour

GUWAHATI: The Gauhati High Court has sentenced Advocate Utpal Goswami, who was convicted of contempt of court for making abusive remarks against an Additional District Judge by inter alia, commenting upon her attire and comparing her with a mythical demon, to six months imprisonment. Convicted Utpal Goswami called the judge “Vashmasur,” and the court sentenced him to 6 months imprisonment under Section 12(1) of the Contempt of Courts Act read with Article 215 of the Constitution of India.

The convicted Utpal Goswami was punished with a sentence of six months imprisonment along with an order of suspension from appearing as an advocate before the District Judiciary or the High Court for a period of 15 days. Justice Kalyan Rai Surana and Justice Devashish Baruah, however, gave him a chance to mend his ways. The court suspended his sentence of imprisonment under the condition that if he is convicted again under the Contempt of Courts Act within the next four years, he will have to serve this sentence.

Utpal Goswami has also been ordered to submit a bail bond to the High Court regarding the case, and it has to remain valid and alive for a period of four years. He will also have to vacate any post that he may hold in his capacity as an advocate.
