Guwahati: Commissioner of Police Prohibits Digging of Public Roads, Imposed Section 144
GUWAHATI: On Tuesday, the Commissioner of Police's office in Guwahati issued prohibitory orders under Section 144 of the Code of Criminal Procedure (CrPC) barring all activities involving the digging of public roads, with some exceptions.
According to the official notification by Deputy Commissioner of Police informed that , “pursuant to the powers vested in me under Section 144 of the Criminal Procedure Code, 1973 read with Govt. of Assam Notification No. HMA.735/2008/Pt-1/243, dated 24.12.2014, I, Sri Imdad Ali, APS, Deputy Commissioner of Police (Admn), Guwahati do hereby issue this order prohibiting all works which involve digging of public roads within the jurisdiction of Police Commissionerate, Guwahati."
The notice further stated that any work involving the digging of public roads must be done with the written authorization of the concerned Road Owning Agency, such as PWD (Roads), or the Deputy Commissioner, Kamrup (Metropolitan) District. The relevant government agency carrying out such work must get the required licence and authorise the implementing firm to carry out such activity.
It also said that after obtaining the necessary permission for digging public roads from the concerned Road Owning Agency such as PWD (Roads) or the Deputy Commissioner, Kamrup (Metropolitan) District, the Government agency/implementing firm shall notify the Deputy Commissioner of Police (Traffic), Guwahati. The notification should include the details of the road/street to be dug, as well as the intended start date and the expected time required to finish the job.
There shall be no haphazard dumping of construction materials or excavated earth on the road. There should be a defined area for storing such materials, with all basic safety precautions in place to avoid disasters and to allow traffic to flow freely.
No such work shall be carried out without prior consultation with the Guwahati Traffic Police.
