Manish Sisodia case can be proceeded even in his absence: CJM, Kamrup

GUWAHATI: In light of the criminal defamation case filed by Himanta Biswa Sarma at the CJM's court, Kamrup against Manish Sisodia, the CJM's court took a decision that the defamation case can be proceeded without the presence of the accused. The grant of exemption from personal appearance to the accused will not be a hindrance to the proceedings of the case.

The CJM's court is moving ahead with the case for taking all necessary legal and punitive actions against the accused, since the complainant claimed that the derogatory speeches made about him by Manish Sisodia, the accused, has maligned his image. According to Himanta Biswa Sarma, the accused had put several allegations on him, which stained his character and image.

Manish Sisodia had accused the Himanta Biswa Sarma of corruption at a press conference in June during the first wave of Covid-19. But Sarma denied the charges put by Sisodia, and filed a criminal defamation case against him.

Considering all the aspects of the case, the CJM's court gave its opinion that Manish Sisodia can be allowed exemption from personal appearance. But after perusal of the petition submitted by the accused, it is seen that the accused has nowhere stated that he has any objection if evidence in this case is recorded in his absence, and that to this effect the accused is prepared to give a fresh undertaking.

The CJM's court has accepted Sisodia's petition under a few conditions. First, Manish Sisodia, the accused, will appear in person before this court as and when directed. Second, the accused will submit an undertaking before this court to the effect that he shall not dispute his identity as an accused of this case. Third, his engaged counsel shall appear before this court on each and every date fixed by this court. And fourth, he has no objection if evidence in this case is recorded in his absence.
