GUWAHATI: The Assam Government on Tuesday again failed to file affidavit on the PIL on fake encounters in the State.

A Public Interest Litigation (PIL) (86/2021) had been filed by Arif Md Yeasin Jwadder under Article 226 of the Constitution of India in Gauhati High Court to issue an appropriate writ or order or direction calling for the records on "fake encounter killings" by police personnel. The PIL was taken up for hearing on Tuesday and the Advocate General sought another 10 days for filing the affidavit. The government had earlier sought time on May 11 to file affidavit.

The petitioner argued that FIR in every incident of police encounter had not been lodged as claimed by the respondent in terms of PUCL judgment. Advocate General Devajit Lon Saikia appeared for the State. Lawyer and activist Arif Jwadder appeared in person.

Jwadder has sought an order from the High Court for the registration of an FIR in the alleged fake encounter cases and an independent investigation by the Central Bureau of Investigation (CBI), a Special Investigation Team (SIT) or a police team from another state, under the supervision of the court. He also sought a judicial inquiry by a sitting Judge of the Gauhati High Court into the alleged encounters and monetary compensation to the families of the victims after due verification. Assam Police, Department of Law and Justice and Assam Human Rights Commission have not yet filed their response in terms of the notices issued to them.
