Candidate deprived in APSC CCE-2015

GUWAHATI: The Supreme Court has refused to interfere with two separate judgments passed by a Single Bench and a Division Bench of the Gauhati High Court, which had directed the Assam Public Service Commission (APSC) to appoint a deprived candidate as an Inspector of Taxes because he was earlier wrongly given low marks in the General Studies paper in the APSC Combined Competitive Examination (CCE) 2015.
The candidate, one Hrishikesh Das, had originally filed a petition before a Single Bench of the High Court in 2017, contending that he obtained low marks in the relevant paper due to faulty evaluation of the answer script. The Single Bench then directed the APSC to enhance the candidate's marks by 10.5 marks in the General Studies paper and appoint him as an Inspector of Taxes.
The APSC challenged this order before a Division Bench of the High Court in October, 2021. However, the Division Bench declined to intervene in the order passed by the Single Bench.
Subsequently, the APSC moved a Special Leave Petition (SLP) in the Supreme Court. After hearing both sides on February 28 last, the Supreme Court refused to intervene in the orders passed by the High Court and dismissed the SLP, thereby paving the way for the appointment of Hrishikesh Das as Inspector of Taxes.
