Noida Man Sentenced To Life For Raping Minor

NEW DELHI: A 40-year-old man was sentenced to life imprisonment for raping a minor girl in 2019. The sentenced was handed by a special Protection of Children from Sexual Offence (POCSO) Court on Monday. The 8-year-old minor was raped in 2019 in Surajpur by the convict Nanhe Mishra.

Mishra lived on the first floor of the same building where the victim lived with her family. A complaint was filed by the child's mother at Surajpur Police station on August 27, 2019. In her complain she narrated, "My husband and I were away at work. Misha lured my daughter to his room and raped her. When I returned home, she narrated the incident to me."

Based on the FIR filed section 376 (rape) of Indian Penal Code, and the relevant sections of POCSO Act were registered the same day.

Mishra was arrested on December 12, 2019 after the chargesheet were filed against him. Meanwhile, Mishra's defence lawyer stated that there was no concrete evidence that his client raped the child. He added, "The child was tutored to testify against my client. My client had not paid rent to the owner, due to which he engaged the complainant to register a false case against him."

The trail court in their judgement stated, "No sperm does not indicate rape has not been committed. This is not material evidence but corroborative evidence. Only corroborative evidence cannot lead to a conclusion." The court further stated that the prosecution has succeeded in proving the charges of the accused beyond reasonable doubt.

Speaking on this, Chandra Mohan Srivastava, special judge (POCSO) stated that Mishra has brought shame to the society by raping a minor girl. His act has tarnished mutual trust. The court sentenced Mishra to life imprisonment and fined Rs 50,000.

In another incident, in September, a 65 year old man was sentenced to life after he was convicted of "digital rape" of a 3 year old girl.
