SC rejects MP Sushmita Dev's petition challenging EC clearing PM Modi and BJP President Amit Shah over Poll Code Violations

New Delhi/Guwahati: The Supreme Court on Wednesday rejects Congress MP Sushmita Dev’s petition challenging the Election Commission’s decision to clear Prime Minister Narendra Modi and BJP National President Amit Shah of poll code violations.

As per media reports, the apex court asked her to challenge the Election Commission's clean chits separately. “The court cannot go into merits of the [EC] order,” it says.

The Supreme Court of India has dismissed a petition filed by Congress MP Sushmita Dev seeking action against PM Narendra Modi and Amit Shah for their comments made during the election campaign this year.

The Silchar MP in her plea had requested to the apex court to issue a direction to the Election Commission of India to take action against the BJP leaders on April 29, 2019.

The Congress petition had objected to EC giving clean chit to the BJP leaders against allegations filed against them and had asked that SC should order EC to revise its decision. But the Supreme Court said that if the petitioner wants to challenge the decision of EC, then a separate independent petition will have to be filed.

She further had alleged that the Election Commission was sitting on the complaints against BJP top leaders. After that, the Supreme Court had issued a notice to the Election Commission to act on the complaints filed against PM Narendra Modi and BJP President Amit Shah, while saying that the EC can pass any order they want.

The bench of Chief Justice Ranjan Gogoi and justice Deepak Gupta said that the original plea was for the disposal of complaints against Modi and Shah, and the EC has already concluded. The bench also noted that the orders of the EC were not challenged in the additional affidavit. As the request of the original petition was already fulfilled, the petition had become infructuous or pointless, hence the same was disposed of by the court.
