The Law Commission is Looking For New Suggestions for Uniform Civil Code

NEW DELHI: Almost four years after the Law Commission of India issued a consultation paper stating that a Uniform Civil Code (UCC) was "neither necessary nor desirable at this stage," the Commission embarked on a new investigation on Wednesday, soliciting views and suggestions on UCC from the general public and recognised religious organisations.

According to the panel, the consultation document on the subject was issued more than three years ago. Given the subject's significance and importance, as well as multiple court orders linked to it, the commission has determined that it is important to re-examine the problem.

Individuals who wish to provide feedback on the UCC may do so by contacting the commission. They can communicate their ideas via the member-secretary's email or the commission's website.

Headed by former Karnataka high court chief justice Ritu Raj Awasthi, in a public notice said that given the passage of more than three years since the issuance of the said Consultation Paper, and in light of the subject's relevance and importance, as well as the various Court orders on the subject, the 22nd Law Commission of India deemed it necessary to revisit the subject.

In June 2016, the Ministry of Law and Justice requested that the Law Commission investigate all aspects of the adoption of a UCC. However, the Law Commission did not submit a final report on the topic and instead provided a consultation paper on "Reform of Family Law" in August 2018.

The commission emphasised in a 185-page consultation report that secularism and cultural diversity could not contradict the country's pluralism.

The Uniform Civil Code, if implemented, would replace personal rules based on religion or area with a set of unified laws that would govern every citizen of India.

A Uniform Civil Code has long been a contentious issue in India, with proponents calling for common law and opponents claiming it would be contrary to the country's socialist secular character.
