Allahabad HC to Hear All Cases Related to the Shri Krishna Janmabhoomi Dispute

ALLAHABAD: Allahabad High Court will now hear all the cases related to the Shri Krishna Janmabhoomi dispute. The cases currently being heard in the lower court in Mathura have been transferred to the HC, by an order passed by it on Friday.

Earlier, on May 3, the high court had reserved its judgment on a plea seeking transfer of the case, from the Mathura district court to the high court, in which Hindu devotees claimed right over the land on which is built the Shahi Masjid Idgah in Mathura.

The Krishna Janmabhoomi case in Mathura holds national importance and should be heard in the high court, it was stated in the petition.

The petition was filed by Bhagwan Shri Krishna Virajman at Katra Keshav Dev Khewat Mathura through Ranjana Agnihotri and seven others, including the counsel for the respondents.

The Management Committee of the Shahi Masjid Idgah next to Krishna Janmabhoomi temple, Shree Krishna Janmabhoomi Trust, Katra Keshav Dev, Deeg Gate, Mathura and Shri Krishna Janma Sthan Sewa Sansthan, Katra Keshav Dev, Deeg Gate, Mathura are the respondents in the case.

A civil suit before the civil judge (senior division) for declaration and injunction was filed by the petitioners, with the claim that the Hindu community had right over the Idgah mosque, going on to state that Hindu temples were demolished before it was constructed.

They also maintained that such construction cannot be a mosque as no Waqf was ever created. The land was never dedicated to the construction of the mosque, the plea stated.

A similar controversy was raised by the petitioners in the case over the alleged presence of Hindu deity idols in the locked basement rooms of the Taj Mahal. The Archaeological Survey of India (ASI) finally settled the debate in July last year, with a single-line answer to an Right to Information (RTI) query.

On June 3, a legal notice was sent by the petitioners in the Shahi Idgah Masjid-Shri Krishna Janmabhoomi dispute suit to the Centre and the ASI, seeking the relocation of idols of Hindu deities, which they claimed were buried under the staircase of an Agra mosque. The sent notice asked for the movement of the public on the staircase to be stopped immediately.

Trinamool Congress (TMC) spokesperson Saket Gokhale had filed a RTI query seeking information from the ASI about the Taj Mahal's history. In answer to Saket Gokhale’s RTI query, seeking proof that there was no temple on Taj Mahal land and there were no idols in the 20 locked basement rooms under the Taj Mahal, the ASI clearly said that there are no idols of Hindu gods and goddesses in the basement of the Taj Mahal, nor was the Taj Mahal built on temple land.
