NEW DELHI: On April 3, Congressman Rahul Gandhi was granted bail in the Surat Court defamation case.
On May 3, there will be a hearing about the appeal of his criminal defamation conviction. Prior to losing his seat in Parliament, he had been found guilty in the case and given a two-year term. During the hearing of the case, Rahul Gandhi and numerous other Congress officials, including Priyanka Gandhi, travelled to Surat.
Rahul Gandhi, the leader of the Congress, appealed his conviction in the criminal defamation case brought against him for his remarks in 2019 regarding the "Modi" surname on April 3. This was done days after a Surat court found Gandhi guilty and sentenced him to two years in prison.
Congress expects the court to seriously consider the case right away. The party is very optimistic that the court will overturn its decision of conviction and restore Gandhi’s ability to serve as a Lok Sabha member.
Senior attorney R S Cheema will appeal the March 23 ruling by chief judicial magistrate H H Verma convicting Rahul Gandhi in the defamation case against his remarks on Modi's surname in 2019. Abhishek Singhvi, a Rajya Sabha MP, has "supervised, controlled, and advised" this appeal.
The trial court gave Rahul Gandhi, who was disqualified as a member, one month to submit an appeal, so the Election Commission stated there was no rush to call the Wayanad Lok Sabha byelection.
According to Rajiv Kumar, chief election commissioner, the election panel has made decisions regarding the vacancies that have existed up until February. The trial court in Surat has given Rahul Gandhi 30 days to seek a judicial remedy for the situation, the CEC announced during a press conference. "We won't rush; we'll wait." There is no rush to complete it before using the specific remedy that the trial court provided. "After that, we'll make a decision," Kumar said.
