VARANASI: The Varanasi District and Sessions Court today dismissed a plea of the Anjuman Islamia Masjid committee on Monday that challenged the maintainability of the suit filed by five Hindu women seeking the right to worship in the Gyanvapi mosque compound.
District Judge A K Vishvesh ordered that it would continue to hear the petition seeking the right to worship in the temple. The hearing is adjourned till September 22.
Advocate Vishnu Shankar Jain, appearing for the Hindu side said, "The court rejected the Muslim side's petition and said the suit is maintainable."
The Sessions Court will in the next session give its decision on whether the structure present inside the Gyanvapi complex is a Shivling or not.
The Hindu Side has also called for an ASI Survey where everything will be as clear as day if the structure inside the mosque is a Shivling or not. They have even asked for the carbon dating of the structure.
The advocate of the Hindu side Vishnu Shankar Jain celebrated the judgment in a tweet by saying, "Today's judgment is a landmark and the misnomer of places of worship act,1991 as well as waqf act 1995 has been rejected. Dharm ki jay ho, adharm ka nash ho(May truth prevail over Injustice)"
The Worship Act 1991 mentioned here prohibits the conversion of any religious place or place of worship and also provides for the maintenance of any place of worship as it existed on the day of independence of this country.
The Hindu side in the case is arguing for Section 3 of the Worship Act which bars the conversion, in full or part, of a place of worship of any religious denomination into a place of worship of a different religious denomination or even a different segment of the same religious denomination.
