Kashmir: SC says Right to access Internet is fundamental right; calls for review of orders

NEW DELHI: While hearing pleas challenging petition on the current situation in Kashmir, the Supreme Court observed on Friday that right to Internet access is a fundamental right and suspending the Internet indefinitely is unconstitutional. The five-judge bench headed by Justice N V Ramana, the Court called for restoring internet services in government websites, localized/limited e-banking facilities, hospital services, etc. It also asked the administration to restore the Internet to facilitate e-banking and trade in Jammu and Kashmir.

"We declare that the freedom of speech and expression and the freedom to practice any profession or carry on any trade, business or occupation over the medium of internet enjoys constitutional protection under Article 19(1)(a) and Article 19(1)(g).," the court said. The court also asked the administration to review restrictions and curbs, including Section 144, within the region in a week's time.

The special status on Jammu and Kashmir, as was guaranteed by Article 370 was removed last year.
