APSC Scam Prime Accused Rakesh Paul Granted Bail by Gauhati High Court

GUWAHATI: Prime accused in the Assam Public Service Commission (APSC) cash for job scam, Rakesh Paul, was granted bail by Gauhati High Court on July 22.

Paul was granted bail in the case filed by the CID. However, his name is yet to be cleared in the case filed at Bhangagarh police station.

Earlier, a Special Judge Court has framed charges against 'disgraced' APSC (Assam Public Service Commission) Chairman Rakesh Paul under Section 7 and 13 (b) of Prevention of Corruption Act along with Section 420 of IPC in the case (27/2018) registered with the CID (Crime Investigation Department).

It is to be mentioned that, the FIR was lodged against Paul by one Son Kumar Baishya.

The complainant alleged that Paul had demanded Rs 10 lakh from him on the pretext of providing job. The complainant stated in the FIR that he had already given Rs 5 lakh as an advance payment to Paul.

Further, absconder Mofidul Islam – a key aide of former APSC (Assam Public Service Commission) Chairman Rakesh Paul – appeared before the Special Judge after he had got bail from Gauhati High Court the previous day.

Earlier, Islam had appealed to the High Court "for setting aside the order dated 28.10. 2019, issuing a non-bailable warrant of arrest and all other subsequent orders passed by the learned Special Judge, Assam."

The High Court had said that "he should be given an opportunity to appear before the learned Trial Court. Therefore, the warrant of arrest issued against the petitioner (Islam) stands recalled. The petitioner is directed to appear before the learned Court within the next seven days."

He has been named in Special Case No. 02/2017 corresponding to Dibrugarh PS case No. 936/2016 under Section 8/12/13 (2) of the Prevention of Corruption Act, 1988 read with Section 109/120 (B)/420/463/468/471/201 IPC. He has been shown in the charge sheet as an absconder. Mentionable, the Court of Special Judge had issued a non-bailable warrant of arrest against Mofidul on October 28, 2019.
