GUWAHATI: Assam Police on Tuesday arrested a constable of Changsari Police Station in Kamrup district of Assam.

The accused constable, identified as Babul Ali and hailing from Mandakata, was arrested on charges of involvement in cattle syndicate.

Constable Babul Ali has been booked under 379/441/13/11 sections of the Indian Penal Code (IPC).

The notable sections under which Ali was booked are 379 and 441 of IPC. Section 379 of IPC relates to punishment for theft. Whoever commits theft shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both, the law states.

On the other hand, Section 441 of IPC relates to "criminal trespass", of a person having lawfully entered into or upon such property, unlawfully remains there with intent thereby to intimidate, insult or annoy any such person or with intent to commit an offence.

It is worth noting that Ali contested as an independent candidate in 2011 State Legislative Assembly election from Kamalpur constituency, according to sources.

The police, however, refused to reveal any other details regarding the arrest due to an ongoing investigation.

It may be mentioned that since last few months Assam Police have been successful in rescuing cattle heads from across the state and arrest the accused.

In two separate incidents last Wednesday, the police has seized as many as 32 cattle which were being transported illegally from the State to Meghalaya.

In the first incident, a team of the Central Guwahati Police District (CGPD) from the Paltanbazar Police Station intercepted a Tata DI truck at Ulubari while it was trying to smuggle six cattle from Nalbari to Meghalaya. Two miscreants involved were arrested.

In the second incident, a team of the East Guwahati Police District (EGPD) from the Khetri Police Station intercepted a truck (AS04 BC 0211) at Topatoli and seized 26 cattle which were being smuggled from Amoni to Byrnihat. Two persons, Ekramul Hoque of Juria and Md Ajharul Islam of Dhing were arrested in this connection

The Assam Cattle Preservation (Amendment) Act, 2021 was passed last year to regulate slaughter of cattle and restrict the transportation of cattle within and from the state.

While the Act prohibits the slaughter of cows, it permits the slaughter of other cattle (bulls, bullocks and buffaloes) if the cattle is over 14 years of age or has become permanently incapacitated due to injury or deformity.

It also restricts intra-state and inter-state transport of cattle, and sale of beef except at permitted locations.

The relevant authority may inspect and seize cattle and vehicles used for offences under the Act

Upon conviction for any offences related to transportation of cattle under the Act, the seized cattle and vehicles will be forfeited to the state government.

The Act also limits the transport of cattle in the north-eastern states where slaughter is not regulated, due to restrictions on transport through Assam.
