GUWAHATI: The Assam government in a bid to repeal the Assam Urban Areas Rent Control Act, 1972 and further to protect the interests of the landlords and tenets tabled the 'Assam Tenancy Bill, 2021' during the state assembly session.

The bill further aims at providing a speedy resolution towards impending disputes between landlords and tenants.

The 'Assam Tenancy Bill, 2021' was introduced by Minister of Parliamentary Affairs Pijush Hazarika, on behalf of Minister of Urban Development Ashok Singhal. It would further repeal the Assam Urban Areas Rent Control Act, 1972.

According to newly introduced 'Assam Tenancy Bill, 2021', artificial cap in fixing the rent would be repealed while both parties- landlord and the tenant shall have to decide it through a mutual agreement and mitigation.

Keeping in mind the long impending property disputes and civil cases in the state, the 'Assam Tenancy Bill, 2021' would simplify the procedures of tenancy in the state along with, resolve disputes between both the parties. The bill would also establish a rent authority, a rent court, and a rent appellate at the district level to keep a check on tenancy norms.

The Bill is also set to keep the interests of both landlords and tenants as it would further simplify the ousting of a tenet on failure to pay the rent or refuses to act as per the agreement. It also removes the fear of landlords of losing the property.

Reportedly, the Bill would not be applicable to certain premises that would include those properties that are owned and run by religious or charitable organizations, government and Waqf authorities.

Meanwhile earlier on August 6, the Assam state cabinet took several important decisions, including that flat owners would not require Government's permission for sale and purchase of flats in Assam.

This came as a major relief for the consumers who earlier had to wait for months in order to complete the necessary official formalities in order to get registration of their property. Shortly after the cabinet meeting was over, this was informed by the Guwahati Development, Urban Development and Irrigation Minister Ashok Singhal.
