Death Penalty awarded to Prime Accused Bikash Das in Radha Kumari Murder-Rape Case

Sivasagar: The District and Sessions Judge, Sivasagar SK Poddar awarded death imprisonment to the prime accused in the sensational Radha Kumari murder-rape case.

The accused identified as Bikash Das was held guilty on September 27, 2019 for committing the offence of punishable under Section 302 & 376 of the Indian Penal Code (IPC) and was convicted accordingly.

As per the final verdict, Convict Bikash Das has been informed about his right of appeal against the judgment and order of conviction and sentence before Gauhati High Court within the next 30 days.

Earlier, the District and Sessions Judge, Sivasagar SK Poddar on September 30, 2019 heard the convict and learned advocate of both sides of sentence and imposition of compensation and recorded the statement of the accused.

On October 3, 2019, the District and Sessions Judge, Sivasagar SK Poddar awarded death sentence to convict Bikash Das for committing the offence punishable under section 302 of the India Penal Code. As per the final verdict, convict Bikash Das will be hanged by the neck till he is dead.

Also, convict Bikas Das is sentenced to undergo Rigorous Imprisonment (RI) for life for the offence punishable under section 376 (1) of Indian Penal Code and also to pay a fine of Rs 10,000.

Furthermore, convict Bikas Das is remanded to District Jail, Sivasagar to serve out the remaining part of the sentence.

The verdict further states that convict Bikas Das is entitled to the benefit of section 428 CrPC for the period already undergone during investigation and trial.

Meanwhile, considering the fact of imposing the meager amount of fine due to poor financial background of the convict, no order is passed for payment of compensation to the victim under section 357 CrPC.
