GUWAHATI: In a landmark verdict, the Gauhati High Court upheld the Assam government's move to convert state-funded madrassas to general educational institutions.

The Gauhati High Court on Friday directed the Assam Repealing Act 2020 under which all madrassa provincialised government-funded institutions to be transformed into general educational institutions in Assam.

Collective members of Gauhati High Court (HC) on Friday took a decision on the Assam Repealing Act of 2020 to abolish the Madrassa Education Provincialisation Act. Gauhati HC also confirmed that about 397 madrassas to converted into general educational schools in Assam.

The Assam Repealing Act 2020 repealed two existing Acts: The Assam Madrassa Education (Provincialisation) Act, 1995 and- The Assam Madrassa Education (Provincialisation of Re-Organisation of Madrassa Educational Institutions and Services of Employees) Act, 2018.

Gauhati HC officials comprising Justice Soumitra Saikia and Chief Justice Sudhansu Dhulia reported that the decisions are taken on this by legislative and executive members are for the madrassas only, and it will not affect the community or private run madrassas.

Assam Chief Minister Himanta Biswa Sarma appreciated the decisions and exclaimed it as a memorial one.

Under The Assam Repealing Act of 2020, it was decided that all madrassa institutions will be turned into upper primary, high and higher secondary schools where there will be no changes in the pay, status, allowances and several service circumstances of the non-teaching and teaching staffs.

Hearing the decisions taken by HC on Friday, several madrassas committee members withdrew the government's decisions and demanded to the HC to review them again.
