KOKRAJHAR: The Bodoland Janajati Suraksha Mancha (BJSM) on Thursday came down against the non-tribal organizations that are opposing the High Court order to evict the illegal encroachers in tribal belts and blocks in Assam and BTC region.
The president of BJSM, Janaklal Basumatary said, "The opposition of eight non-tribal bodies against eviction proceeding of illegal encroachers comprising non-protected, non-tribal people from BTC is illegal. This eviction order is not only for BTC but for entire Assam. This eviction order is not from the BTC government or the Assam Government. It is the order of Gauhati High Court with direction to BTC and Assam Government to implement the provision of chapter X of Assam Land and Revenue Regulation 1886 as amended in 1947 in letter and spirit and to evict the identified encroachers comprising non-protected non-tribal people residing after the creation of belts and blocks beginning from 1947."
Basumatary said that the order was not for non-tribals residing before the creation of tribal belts and blocks but for those non-protected non-tribal people who were residing by occupying land in tribal belts and blocks after the creation of tribal belts and blocks. They are treated as illegal encroachers and liable to be evicted forthwith as per provision of the land law of Assam. He said that the Government of Assam had submitted a list of such illegal encroachers to the court and the court ordered DCs of the districts of Assam and Principal Secretary of BTC to carry out eviction proceeding against the identified encroachers to implement the provision of chapter X of the Assam land law in letter and spirit.
"This cannot be stopped by the Assam Government or the BTC government. The DCs and Principal Secretary cannot disobey this court order, else it will be considered as contempt of court. So the opposition of the eight non-tribal organizations is illegal and without jurisdiction," he said.
"For protection of tribal people from forceful occupation of their land by non-tribal migrants, the sixth schedule administration has been provided for protection of land, politics, cultural and linguistic rights of tribal people. The government is duty bound to protect it. So the eight non-tribal organizations have no right to oppose the High Court order to evict the illegal encroachers as per the land law of Assam," he added.
