Silchar court issues notice to AICC president Mallikarjun Kharge, 11 others

SILCHAR: Taking cognizance of a title suit filed by two Congress Block presidents of Cachar district, a Silchar court had issued notices to All India Congress Committee (AICC) president Mallikarjun Kharge and 11 others.

Khairul Islam Barbhuiyan and Md. Islam Uddin Laskar, Block Congress presidents of Sonai and Banskandi respectively, had filed a title suit challenging the election of Abhijit Paul as Silchar District Congress Committe. They even challenged the election of Kharge as the AICC president as they alleged that the constitutional provision as well as all rules of justice were flouted by the APCC as they manipulated the list of state committee members for the election of the AICC president by inclusion of names of people outside the elected ones and deleting the names of the elected persons. Hence, the election of Kharge was vitiated and liable to be set aside, they claimed in their petition.

Barbhuiyan and Laskar, who claimed themselves as the legitimate Block Congress presidents, alleged that the election of Paul had clearly violated the constitution of the Congress. Sajal Acharjee was the only person who had filed nomination for the post of Silchar DCC and Paul was his proposer. Maintaining this, they said, as per the rules Acharjee should have been elected unopposed. But flouting all the norms, Paul was declared as the DCC president. They further alleged that Paul, after assuming the post of DCC president had made Akhtar Hussain Barbhuiyan and Husanul Haque Laskar the presidents of Sonai and Banskandi Block Congress respectively.

After hearing the plea, Moitree Dekadoloi, Civil Judge No 2, Cachar on July 5 issued notices to Madhusudan Mistry, chairman of Congress Central Election Authority, Kharge, Harun Yusuf, Returning Officer of APCC, N Rupak Turuk, District Returning Officer of the PCC, Jitendra Singh, AICC general secretary in-charge of Assam, Prithviraj Sathe, AICC secretary, Bhupen Bora, APCC president, Manas Bora, APCC general secretary, Abhijit Paul, Silchar DCC president, Akhter Hussain Barbhuiyan, Husanul Haque Laskar and Sajal Acharjee. The next date of hearing was fixed on September 8.

Further the petitioner moved the court seeking injunction on the election of Abhijit Paul as the Silchar DCC president.
