Kokrajhar: After intense protest by local people and physical visit and intervention of BTC chief Hagrama Mohilary, the Supreme Court of India has finally issued notice to M/s Carbon Resources Pvt. Ltd. situated at village Kukurmari in Chirang district for setting up of the calcinated carbon industry in the BTC sixth schedule area without obtaining prior approval from the BTC authority.
Sources from BTC informed that the Supreme Court of India vide order dated 16.09.2019 issued show cause notice for cancellation of the land mutation. As such, four weeks returnable notice has been issued to M/s Carbon Resources Pvt. Ltd. and a status quo order as on 16.09.2019 has been passed by the Supreme Court of India against both the parties.
M/s Carbon Resources Pvt. Ltd. is not a resident of BTC area nor possesses any land in BTC area prior creation of BTC Sixth Schedule in the year 2003. As there is restriction in purchasing land in tribal area by an outsider, a show cause notice was issued to M/s Carbon Resources Pvt. Ltd. for cancelation of land mutation but due to interim order passed by the Gauhati High Court in the year 2017, BTC could not take follow-up action from the show cause notice served to the industry concerned.
The BTC authority decided to move the Supreme Court of India as per the advice of Bidhan Das, Law Officer, BTC. Mukul Rohatagi, senior advocate, Supreme Court of India and former Attorney General of India and Jitendra Kumar Mohapatra, advocate, Supreme Court of India, are representing the case on behalf of BTC authority.
