Gauhati High Court Tells School: Follow RTE or Face De-Recognition

GUWAHATI: A Gauhati High Court's division bench, led by Chief Justice Sandeep Mehta, reprimanded the counsel appearing on behalf of a Guwahati-based private school for denying admission to children belonging to economically weaker sections and disadvantaged groups under the RTE Act. A PIL to this effect was filed by ‘We for Guwahati Foundation’.

The petitioners, through an affidavit, brought on record that children were denied admission by the school authorities concerned on the grounds that no such provision of free admission applies to the school concerned. In some cases, the affidavit noted that the parents were asked to pay all fees and secure admission. The petitioners brought all fee receipts charged by the school concerned on record before the Court. In light of the same, the Court directed the counsel appearing for the private school to ensure that the school adheres to the provisions of the RTE Act.

Directions were also issued to the Education Department to take immediate steps against other schools that were found to be charging fees to economically weaker children seeking admission under the RTE Act.
