JUDICIAL INQUIRY REPORT ON CCE-2013: Gauhati High Court issues notice to the government

GUWAHATI: The Gauhati High Court issued a notice to the State Government to respond after four weeks on the writ petition filed against the committee headed by the Chief Secretary not taking any action on the report of Justice (retd) BK Sharma on the CCE-2013 under the APSC, nor issuing any public notice on it.

The respondents, in this case, are the State of Assam, represented by the Chief Secretary to the Government of Assam, the Principal Secretary to the Government of Assam, Personnel Department, the Principal Secretary to the Government of Assam, Department of Home and Political, Director General of Police, Assam, and the Committee constituted for implementation of the one-man inquiry commission headed by Justice (retd) B K Sharma, retired Judge of the Gauhati High Court regarding anomalies and malpractices in the conduct of examinations by APSC in CCE -2013 (represented by its Member Secretary).

The Assam Government had instituted the Justice (retired) Biplab Kumar Sharma Commission to inquire into the alleged anomalies in the Combined Competitive Examination (CCE) 2013 of the Assam Public Service Commission (APSC). However, the report of the Commission has not been made public as yet.

On behalf of Fight Against Injustice of APSC, Manash Pratim Baruah and another filed a writ petition (WP-C, 5736/2022) in the Gauhati High Court. In the petition, the petitioner stated, "....the report of the learned Judicial Commission was collected on 02.04.2022 by the Principal Secretary, Home and Political Department that too after giving promotion to many ACS officers of the said CCE-2013 batch, on 01.04.2022. As per media reports, many disputed candidates whose anomalies were detected by learned Judicial Commission also got a promotion on 01.04.2022."

"It is stated that serious anomalies were found to have crept into the whole examination process of CCE, 2013 as a result of the outbreak of unprecedented corruption in its many facets which not only vitiated the selection process in unbelievable proportion but also left a serious blot in the otherwise chequered history of civil service in Assam. Accordingly, there is no bar to publishing the report of the learned Judicial Enquiry Commission. Surprisingly, in the face of the action of the State Government since they deliberately refrained from publishing and implementing the report of the judicial commission and promoted the disputed candidates, which is not permissible in the eye of law."
