GUWAHATI: The Gauhati High Court has issued a notice to the Centre, state government and the Karbi Anglong Autonomous Council (KAAC) regarding alleged usurpation of the Council's powers by the government of Assam.
The notice was issued by a Division Bench comprising Chief Jusitce RM Chhaya and Justice Soumitra Saikia on the basis of a Public Interest Litigation (70/2022) filed by Rensing Bey, former Chief Executive Member (CEM) of the KAAC.
Bey has submitted in his petition that the KAAC and the North Cachar Hills Autonomous Council (NCHAC) have been allocated legislative and executive powers over 39 Subjects. However, Bey has alleged "gradual and systematic encroachment and usurpation" by the state government of these powers granted to the Councils under the Sixth Schedule of the Constitution. As a result, the PIL alleged, the KAAC and NCHAC are not being able to function independently.
