GUWAHATI: The Supreme Court Collegium, headed by Chief Justice of India (CJI) DY Chandrachud, has recommended the names of two advocates for appointment as judges of the Gauhati High Court.

The two advocates recommended by the SC Collegium for elevation to the rank of judges are N. Unni Krishnan Nair and Kaushik Goswami.

Earlier, on May 29, 2023, the Chief Justice of the Gauhati High Court, in consultation with his two senior-most colleagues, recommended the elevation of the two advocates as judges of the Gauhati High Court.

“We have duly taken note of the views received from the constitutional authorities of the States of Assam, Arunachal Pradesh, Mizoram, and Nagaland. In order to ascertain the fitness and suitability of the above-named persons for elevation to the High Court, we have consulted our colleagues conversant with the affairs of the Gauhati High Court,” said a note from the Collegium.

The recommendation letter also said that for the purpose of assessing the merit and suitability of advocates N. Unni Krishnan Nair and Kaushik Goswami for elevation as judges of the High Court, the Collegium had scrutinized and evaluated the’materials placed on record,’ including the observations made by the Department of Justice. It was mentioned that they had also looked into the complaints received against some of the candidates.

The communiqué also mentioned that all four consultee judges have unanimously given a positive opinion on the suitability of N. Unni Krishnan Nair and Kaushik Goswami for appointment as judges of the High Court.

Nair’s extensive practice, which is reflected in his substantially high professional income and a large number of reported judgements delivered in cases in which he appeared or argued, served to clinch the matter in his favour. In Goswami’s case, the inputs provided by the Department of Justice in the file indicated that his professional competence is viewed to be good and nothing adverse came to notice against his integrity.

“The Collegium resolves to recommend that (i) N. Unni Krishnan Nair and (ii) Kaushik Goswami, Advocates, be appointed as Judges of the Gauhati High Court. Their inter se seniority be fixed as per the existing practice,” it was added.
