GUWAHATI: The state government stated before the Gauhati High Court that proper steps for engaging Assistant Government Pleaders in all the Foreigners Tribunals are underway.
This was submitted by the senior counsel for the state government’s Home Department, D. Nath, while responding to the plea raised by H.K. Das, appearing as Amicus Curiae of the Gauhati High Court, regarding the non-availability of Assistant Government Pleaders in as many as 8 to 9 Foreigners Tribunals in Assam.
Notably, Amicus Curiae, a legal term in Latin, means “friends of the court.” It refers to a person or organization that is not a party to a legal case but is permitted to assist the court. They can do this by providing information, expertise, or insight that is relevant to the case.
Nath submitted that proper steps for engaging the Assistant Government Pleader in all the Foreigners Tribunals are underway, and therefore, updated instructions would be obtained by him and placed before the court on the next date.
There are 100 Foreigners Tribunal functioning in Assam.
Assistant government pleaders conduct cases on behalf of the government in the Foreigners’ Tribunals.
Judges and Advocates are appointed as members of FT under the Foreigners Tribunal Act, 1941, and Foreigners Tribunal Order, 1964, as per the guidelines issued by the government from time to time.
Referring to the other issue raised during the course of the hearing, advocate Nath submitted that in so far as the repair and renovation of the lavatory facility in the 1st Foreigners Tribunal, Silchar, Cachar, is concerned, an estimate has already been prepared and submitted before the Home Department for necessary approval, and therefore, the matter is under process.
The bench of Justice Suman Shyam then said that it appeared from the submissions of the counsel for both sides that there is no other urgent issue arising for consideration by this monitoring bench in this matter at this stage. In view of this and considering the fact that the winter vacation is approaching, the bench directed the Registry to list this matter again on January 19, 2024.
